Terms of Use

These terms are the agreement between you and Canicel Investments Inc. ("we", "us") for using the Flirtie app and this website (together, "Flirtie"). By downloading or using Flirtie you agree to them. If you do not agree, please do not use Flirtie. Our Privacy Policy explains how your information is handled.

1. Who can use Flirtie

You must be at least 18 years old, and old enough to enter into a contract where you live. Flirtie is not for children or teenagers. The app asks for your date of birth, and you agree to answer truthfully. We may limit or end access if we believe a person is under 18. You may use Flirtie only where doing so is lawful.

2. Ava is an AI

• Ava, and any other character in Flirtie, is a computer program. She is not a human being, and there is no person writing or speaking her side of the conversation. Her messages, her voice, her calls and her pictures are generated by AI.
• Ava can be wrong. She can misremember, make things up, or say something that sounds certain and is not true. Do not rely on what she says as fact, and check anything important for yourself.
• Ava is not a doctor, therapist, counsellor, lawyer, financial adviser or any other professional. Nothing she says is medical, mental health, legal, financial or other professional advice, and Flirtie is not a substitute for professional care or for the people in your life.
• Flirtie is not an emergency service. If you or someone else is in danger or thinking about self-harm, contact your local emergency number or a crisis line straight away (in the United States you can call or text 988).
• Ava's replies are produced automatically and do not represent our views. Tell us about anything she says that seems harmful through Settings, Help in the app.

3. Your account and your data

Flirtie creates an anonymous account for you; there is no password. Your conversations and Ava's memories live on your iPhone. If you delete the app or lose your iPhone without Backup turned on (and Sign in with Apple, to carry it to a new iPhone), they cannot be recovered, and neither can unspent credits. You are responsible for keeping your iPhone secure. The Face ID lock in Settings can help.

4. Acceptable use

Flirtie is for your own personal, non-commercial use. You agree not to:

• use Flirtie if you are under 18, or help someone under 18 to use it;
• use it to create, request or share sexual content involving minors, or any content that sexualises minors, under any circumstances;
• use it for anything illegal, or to plan or encourage harm to yourself or anyone else;
• send or share content you have no right to share, including other people's private information or intimate images of anyone without their consent;
• harass, threaten or abuse other people, including on the Ideas board and in Help;
• try to break, overload, copy, reverse engineer or get around the limits and safeguards of the app, its AI or its servers, or use bots or scripts to access them;
• resell, rent or commercially exploit Flirtie or anything it produces as a service of your own;
• present what Ava generates as if a real person had said or made it, in order to mislead someone.

We may limit, suspend or end access for anyone who breaks these rules, and we may remove posts from the Ideas board.

5. Your content

What you write, say and send in Flirtie remains yours. You give us permission to process it, and to pass it to the service providers named in the Privacy Policy, only as needed to run Flirtie for you: for example to produce Ava's replies, to turn speech into text, and to store your encrypted backup.

Ideas and comments you post on the Ideas board are visible to other people who use Flirtie. If you send us an idea or other feedback about Flirtie, you agree that we may use it freely, without payment or credit, to improve the app.

Subject to these terms, you may use what Ava says and makes in your conversations for your own personal purposes. Because it is AI-generated, it may not be unique, and other people may receive similar results.

6. Flirtie+ subscriptions

Flirtie is free to download and free to chat. Flirtie+ is an optional subscription that adds extra features, such as unlimited call time and letting Ava look things up for you. What it includes is shown in the app before you subscribe.

• Plans. Flirtie+ is offered as a weekly plan and an annual plan. The price for each, in your currency, is shown in the app before you confirm.
• Billing. Payment is charged to your Apple Account when you confirm the purchase. We do not receive or store your payment details.
• Automatic renewal. Your subscription renews automatically for the same period (a week or a year) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the current period ends.
• Free trials. If a free trial is offered and you start one, your paid subscription begins when the trial ends, and you are charged then unless you cancel at least 24 hours before the trial ends. A trial is available once.
• Cancelling. You can manage or cancel your subscription at any time in your Apple Account settings (on your iPhone: Settings, your name, Subscriptions), or from Settings in Flirtie under Flirtie+, "Manage subscription". Deleting the app does not cancel a subscription. When you cancel, Flirtie+ stays active until the end of the period you have paid for and then stops.
• Price changes. If the price of your plan changes, Apple will tell you in advance, and where required you will be asked to agree before the new price applies.

7. Credits

Credits are sold in packs as one-time purchases. They are separate from Flirtie+ and do not renew. Credits can be used only inside Flirtie, for gifts for Ava and for clothes. The price of each item in credits is shown before you buy it.

• Credits, and the things you get with them, are a limited licence to use a feature of the app. They are not money, have no cash value, and cannot be exchanged for cash, transferred to another person, or used outside Flirtie.
• Credits do not expire while Flirtie is available.
• Once credits are spent, the purchase of that item is final.
• Your credit balance and the things you own are stored on your iPhone and in your backup. If you delete the app or lose your iPhone without a backup, they may be lost and we may not be able to restore them.
• We may change what gifts and clothes are offered and what they cost in credits.

8. Refunds

All purchases are made through Apple's App Store, and Apple decides refunds. We cannot issue refunds ourselves. To ask for one, go to reportaproblem.apple.com or contact Apple Support. Except where the law gives you a right to a refund, payments are non-refundable, including for the unused part of a subscription period and for unused credits. Nothing in these terms takes away rights you have under the consumer laws of your country.

9. Changes to Flirtie

Flirtie is still growing. We may add, change or remove features, characters and items, change what is free and what is part of Flirtie+, set reasonable limits on use, and update the AI behind Ava, which can change how she talks. We try to keep Flirtie running smoothly but do not promise that it will always be available or free of errors. If we ever close Flirtie for good, we will try to give reasonable notice in the app.

10. Other services

Flirtie relies on services run by others, such as Apple and the AI providers named in the Privacy Policy, and Ava can show you links, places and search results from the web. We do not control those services or that content and are not responsible for them. Your use of them may be subject to their own terms.

11. Our rights in Flirtie

The app, its characters, their looks and voices as designed for Flirtie, the rooms, artwork, text, software and the Flirtie name and logo belong to us or to those who license them to us. We give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as allowed by these terms and by the App Store's usage rules. All other rights are reserved.

12. Ending

You can stop using Flirtie at any time. To end your account, use "Delete my data from the server" in Settings under Privacy, then delete the app. Remember to cancel any subscription in your Apple Account settings first, since deleting the app or your account does not cancel it.

We may suspend or end your access if you seriously or repeatedly break these terms, if we must do so by law, or if we stop offering Flirtie. If we end your access because you broke these terms, you are not entitled to a refund from us for unused time or credits, except where the law says otherwise. The sections of these terms that by their nature should continue (such as 5, 11, 13, 14 and 16) continue after the agreement ends.

13. No warranties

Flirtie is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind about it, whether express or implied, including that it will be accurate, reliable, uninterrupted, secure, or fit for a particular purpose. You use Flirtie, and rely on anything Ava says, at your own risk.

14. Limits on our liability

To the fullest extent the law allows, we and our officers, employees and partners are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or emotional distress, arising from your use of Flirtie or from anything the AI says or does. Our total liability for all claims relating to Flirtie is limited to the greater of the amount you paid for Flirtie in the twelve months before the claim arose and 50 US dollars.

Some countries and states do not allow some of these limits. Nothing in these terms limits liability that cannot be limited by law, or takes away consumer rights that cannot be waived.

15. If your use causes a claim

If someone brings a claim against us because you broke these terms or the law while using Flirtie, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

16. Apple

These terms are between you and us, not Apple. Apple is not responsible for Flirtie or its content, and has no obligation to provide maintenance or support for it. If Flirtie fails to meet a warranty that applies, you may tell Apple and Apple will refund the purchase price of the app, if any. Apple has no other warranty obligation for Flirtie. Apple is not responsible for dealing with any claims about Flirtie, including product liability claims, claims that it fails to meet a legal requirement, consumer protection or privacy claims, or claims that it infringes someone's intellectual property rights. You confirm that you are not in a country under a United States government embargo and are not on a United States government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow the App Store's terms when using Flirtie.

17. General

If you have a problem with Flirtie, please contact us first; most things can be sorted out quickly. If a part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a part of these terms right away, we have not given up the right to do so later. You may not transfer your rights under these terms to someone else. We may transfer ours as part of a sale or reorganisation of the business.

18. Changes to these terms

We may update these terms as Flirtie changes. The date at the top shows the latest version. If a change is significant, we will make that clear in the app or on this page before it takes effect. If you keep using Flirtie after the new terms take effect, you accept them. If you do not agree, stop using Flirtie and cancel any subscription.
